We at Movemeant, Inc. (“Movemeant” “we”, “our” or “us”) created this privacy policy (“Privacy Policy”) because we know that you care about how the information you provide to us is used and shared. This Privacy Policy relates to the information collection and use practices of Movemeant in connection with the promotion and facilitation of our mission and programmatic activities, which are made available to you through our website located at: https://www.movemeantfoundation.com (“Site”). This Privacy Policy applies solely to the Personally Identifiable Information collected from Movemeant program participants, Movemeant Meant to Move Grant applicants, donors, and other Site users (“user” or “you”) who visit, interact, engage and/or use our Site.

Please read our Privacy Policy carefully to get a clear understanding of how we collect, use, protect or otherwise handle your Personally Identifiable Information in accordance with the functionality of our Site. Specifically, this Privacy Policy will notify you of the following:

  1. What Personally Identifiable Information is collected from you through our Site or while rendering our services, how it is used, and with whom it may be shared;

  2. What choices are available to you regarding the use of your data;

  3. The security procedures in place to protect the misuse of your information; and

  4. How you can correct any inaccuracies in the information and request to be forgotten.

By visiting our Site, or by permitting your child to use our Site, you are agreeing to the terms of this Privacy Policy and the accompanying Terms of Use. Capitalized terms not defined in this Privacy Policy shall have the meaning set forth in our Terms of Use.

Information We Collect from Site Visitors

When contacting us either through an inquiry submission to get involved with any of Movemeant’s current programs, grants and/or athletic scholarships, resources for parents and teachers, events and partnerships; making a donation on the Site; or registering for promoted events through the Site, you may be asked to enter your name, email address, organizational affiliation, purpose for inquiry, primary state of residency, user type, professional title (if applicable), phone number, payment information (for donations), or other relevant details, which we collect to help you with your experience on our Site. We may also collect information you have shared, such as general feedback, testimonials, comments, clarifications, and other general inquiries submitted through the Site. By using our Site, you consent to the collection and processing of your Personally Identifiable Information as described in this Privacy Policy, including the transfer, use, and storage of your personal data for the uses set forth hereunder.

Like most websites, we may also use automatic data collection technology when you visit the Site, such as Google Analytics Tracking, to record information that identifies your computer, to track your use of our Site, and to collect certain basic information about you and your internet browsing habits. This information includes information about your operating system, your IP addresses, browser type, and language, referring and exit pages and URLs, keywords, date and time, amount of time spent on particular pages, what sections of a website you visit, and similar information concerning your use of the Site (the “Usage Information”).

We collect this Usage Information by using cookies and pixel tags (also called web beacons or clear gifs). Cookies are small packets of data that a website stores on your computer’s hard drive so that your computer will “remember” information about your visit. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of website users. You can reject cookies by following the directions provided in your Internet browser’s “help” file. If you reject cookies, you may still visit the Site, but may not be able to use or maximize the functionality of some areas of the Site.

How We Use Information Collected from Site Visitors

We will only use your information in accordance with the law. Specifically, we intend to use your information in the following ways: to communicate with you regarding the reason you contacted us, such as responding to an inquiry submission to get involved with Movemeant’s Youth Coaching; to monitor usage of our Site to inform improvements that might be made to the Site to better serve you; to detect, prevent and address technical issues; to send you periodic emails, newsletters, or other modes of communication to elicit feedback regarding our organization, provide donor receipts and/or solicitations for additional donor support opportunities; to notify you of changes to our Privacy Policy; to evaluate primary residency jurisdiction of donors to determine whether such donation triggers a regulatory compliance filing to comply with charitable solicitation laws; to ensure compliance with a legal obligation; or for any other purpose described when you provide information or with your consent.

Any use of automatic data collection technology may be to leverage unique identifiers associated with your device to assist us in collection and analyzing future data collected. We may additionally use cookies to keep you logged in, save your preferences, track your Site usage status, and/or look up your Site usage data.

How We Share Information Collected from Site Visitors

Although we may need to provide your information to trusted third parties to the extent necessary to optimize our Site and the user experience, we will not sell or trade this information to outside parties. Specifically, we may share or disclose your Personally Identifiable Information in the following ways:

  • We may share Personally Identifiable Information with our service providers if necessary for them to perform a business, professional, or technology support function for us.

  • If we or all or substantially all of our assets are acquired, we expect that the information that we have collected, including Personally Identifiable Information, would be transferred along with other business assets.

  • We may disclose Personally Identifiable Information if permitted or required by law, for example, in response to a court order or a subpoena. To the extent permitted by applicable law, we also may disclose Personally Identifiable Information collected from children (i) in response to a law enforcement or public agency’s (including schools or children services) request; (ii) if we believe disclosure may prevent the instigation of a crime, facilitate an investigation related to public safety, or protect the safety of a child using our sites or applications; (iii) to protect the security or integrity of our sites, applications, and other technology, as well as the technology of our service providers; or (iv) enable us to take precautions against liability.

  • The identity of our donors, and the amount of such donation, may be disclosed on our IRS Form 990 Informational Tax Return, or required state annual regulatory compliance filings, if required by law.

  • Parents or Legal Guardians may request information about the Personally Identifiable Information we have collected from their child by contacting us at info@movemeant.org.

How We Protect Your Information

We take commercially reasonable steps to protect your Personally Identifiable Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Please understand, however, that no security system is impenetrable. We cannot guarantee the security of our databases, nor can we guarantee that the information you supply will not be intercepted while being transmitted to and from us over the Internet. In particular, e-mail sent to or from us may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail.

To help prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect, including, but not limited to, the following:

  • Our Site is scanned on a regular basis for security holes and known vulnerabilities in order to make your visit as safe as possible.

  • We implement a variety of security measures when a user makes a contribution, submits, or accesses their information to maintain the safety of your Personally Identifiable Information.

  • In addition, information you supply is encrypted via Secure Socket Layer (SSL) technology.

While we use systems to protect sensitive information transmitted online, we also protect your information offline. Only authorized agents of Movemeant who need the information to perform a specific job (i.e. to operate, develop, improve or support our Site and/or programs) are granted access to Personally Identifiable Information and are required to keep the information confidential.

Parental/Legal Guardian Choices and Controls

At any time, parents or legal guardians (“Parent” or “Parents”) can review information we have collected about their children, can refuse to permit us to collect further Personally Identifiable Information from their children in association with a use of our Site, and can request that we delete from our records the Personally Identifiable Information we have collected from their child. To exercise these rights, you may contact us at info@movemeant.org. You will be required to authenticate yourself as the child’s Parent to receive information about that child. Further, if you wish to stop receiving promotional e-mails, you may do so by contacting us at info@movemeant.org. You may also choose to unsubscribe from our emails by following the instructions in the bottom of most correspondence, if applicable.

Links to Third Party Sites

The Site may contain content, services, program participation solicitations, resources, advertising, and other materials that link to websites operated by third parties or that utilize application plug-ins to enhance Site functionally (“Third-Party Sites”). We have no control over Third-Party Sites, and this Privacy Policy does not apply to them. Please refer to the privacy policies of those Third-Party Sites for more information on how the operators of those sites collect and use your Personally Identifiable Information. Although the following is not an exhaustive list, here are a few Third-Party Sites that we may utilize or link to within our Site: MailChimp, Facebook, Google Adsense, Instagram, Flodesk, Paypal, and charitable partners carrying out collaborations in furtherance of our mission and/or our programs.

California Users- California Online Protection Act

We strive to educate Parents and kids about how to appropriately safeguard their privacy when using our Site. We are committed to complying with the Children’s Online Privacy Protection Act of 1998 (“COPPA”), which requires us to inform Parents about our information collection and use practices. COPPA also requires that we obtain parental and legal guardian consent before we allow children under the age of 13 to access and/or use our Site. We urge kids to check with their Parents before entering information through our Site, and we recommend that Parents discuss with their kids restrictions regarding the online release of Personally Identifiable Information (as defined herein) to anyone they don’t know.

California law permits users who are California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed their Personally Identifiable Information (if any) for their direct marketing purposes in the prior calendar year, as well as the type of Personally Identifiable Information disclosed to those third parties. We do not currently share Personally Identifiable Information with third parties for their own direct marketing purposes without your prior consent. Accordingly, you can prevent disclosure of your Personally Identifiable Information to third parties for their direct marketing purposes by withholding consent.

To obtain this information, please send an email message to with “Request for California Privacy Information” in the subject line and in the body of your message. We will provide the requested information to you in response. Please be aware that not all information sharing is covered by California’s “Shine the Light” requirements, and only information on covered sharing will be included in our response.

Further, the California Online Privacy Protection Act (“CalOPPA”) requires commercial websites and online services to post a privacy policy. The law’s reach stretches well beyond California to require any person or company in the United States (and conceivably the world) that operates websites collecting personally identifiable information from California consumers to post a conspicuous privacy policy on its website stating exactly the information being collected and those individuals or companies with whom it is being shared. We comply with CalOPPA and agree to the following:

  • Users can visit our site anonymously.

  • There is a link on our home page to our Privacy Policy.

  • Our Privacy Policy link includes the word “Privacy” and is easily found on our Site.

  • You will be notified of any Privacy Policy changes on our Privacy Policy page.

  • You can change or delete your Personally Identifiable Information by emailing us at info@movemeant.org.

Finally, commencing in January 2024 subject to applicability to this Site, in accordance with AB-2273 The California Age-Appropriate Design Code Act, we will not sell the Personally Identifiable Information of our users, regardless of age, be it in the form of contact information, geolocation information, or otherwise. Further, we will conduct a Data Protection Impact Assessment prior to launching any new online service, product and/or features accessible to the public on our Site, which we will make available to the Attorney General upon written request within 5 business days.

If you are a California resident who is under age 18 and you are unable to remove publicly available content that you have submitted to us, you may request removal by contacting us at: info@movemeant.org. When requesting removal, you must be specific about the information you want removed and provide us with specific information, such as the URL for each page where the information was entered, so that we can find it. We are not required to remove any content or information that: (1) federal or state law requires us or a third party to maintain; (2) was not posted by you; (3) is anonymized so that you cannot be identified; (4) you don’t follow our instructions for removing or requesting removal; or (5) you received compensation or other consideration for providing the content or information. Removal of your content or information from the Site does not ensure complete or comprehensive removal of that content or information from our systems or the systems of our service providers. We are not required to delete the content or information posted by you; our obligations under California law are satisfied so long as we anonymize the content or information, or render it invisible to other users and the public.

Fair Information Practices

The Fair Information Practices Principles form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe. Understanding the Fair Information Practice Principles and how they should be implemented is critical to comply with the various privacy laws that protect personal information. There are five (5) core principles of Fair Information Practice: (i) consumers should be provided notice of whom the information is going to and what it will be used for; (ii) choices should be offered and consent required; (iii) consumers should be able to access and alter data; (iv) data should be accurate and secure; and (v) mechanisms in place for enforcement and redress are necessary. In order to be compliant with Fair Information Practices we will take the following responsive action, should a data breach occur:

  • We will notify you via email within seven (7) business days.

  • We will notify users via in-site notification within seven (7) business days.

We also agree to the Individual Redress Principle which requires that individuals have the right to legally pursue enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires not only that individuals have enforceable rights against data users, but also that individuals have recourse to courts or government agencies to investigate and/or prosecute non-compliance by data collectors and processors.

Notice for International Users

The Site is designed for and targeted to United States audiences and are governed by and operated in accordance with the laws of the United States. We make no representation that the Site is operated in accordance with the laws or regulations of any other nations. Information collected through the Site may be stored and processed in the United States or any other country in which we or our service providers maintain facilities. Our service providers may transfer information that we collect about you, including Personally Identifiable Information, across borders and from your country or jurisdiction to other countries or jurisdictions, some of which may not have the same data protection laws as your jurisdiction. By using the Site and providing us with information directly or indirectly, you consent to the transfer of information to the United States. or to any other country in which our service providers maintain facilities for processing by us in accordance with this Privacy Policy.

Changes to This Privacy Policy

This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We may change this Privacy Policy from time to time and will post any changes on the Site as soon as they go into effect. By accessing the Site after we make any such changes to this Privacy Policy, you are deemed to have accepted such changes. Please refer back to this Privacy Policy on a regular basis.
